Terms of Service

These Terms of Service (“Terms”) govern your use of the BodyTune website and mobile app (together, the “Service”), operated by BodyTune. By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Health disclaimer — please read

BodyTune provides general fitness and wellness information. It is not medical advice, diagnosis or treatment, and it is not a substitute for care from a qualified healthcare professional. Consult a doctor before starting any exercise or nutrition programme, especially if you are pregnant, have a medical condition, are recovering from an injury, or are taking medication. If you experience pain, dizziness or discomfort while exercising, stop immediately and seek medical help. You use the plans in the Service at your own risk.

2. Eligibility

You must be at least 13 years old to use the Service, and at least 18 to purchase a subscription. If you are between 13 and the age of majority where you live, you may only use the Service with the involvement of a parent or guardian.

3. Your account

• Provide accurate information and keep it up to date.
• Keep your password confidential; you are responsible for activity on your account.
• Tell us promptly at support@bodytune.com if you suspect unauthorised use.
• One account per person. Do not share or transfer your account.

4. Free and premium features

The core BodyTune app is free to download and use. Optional premium features are offered as a paid subscription. Prices, billing periods and what is included are shown in the app before you buy.

5. Subscriptions, billing and cancellation

• Subscriptions are purchased and billed through the Apple App Store or Google Play, and are subject to that store’s terms as well as these Terms.
• Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
• You can cancel or manage your subscription at any time in your App Store or Google Play account settings. Cancelling stops future renewals; it does not shorten the period you have already paid for.
• Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases directly.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in breach of these Terms.
• Copy, scrape, resell or redistribute any part of the Service or its content without our written permission.
• Reverse engineer, decompile or attempt to extract the source code of the app, except where that right cannot be excluded by law.
• Interfere with the Service, probe it for vulnerabilities without permission, or attempt to access another user’s account or data.
• Upload content that is unlawful, abusive, misleading or infringes anyone’s rights.

7. Content you provide

You keep ownership of the data and content you enter, such as your logs, photos and measurements. You grant us a limited licence to host, store and process that content solely to operate and improve the Service for you, as described in our Privacy Policy. You are responsible for the accuracy of what you enter — the plans the app generates depend on it.

8. Our intellectual property

The Service, including its software, design, text, graphics, logos and the BodyTune name, is owned by BodyTune or its licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use.

9. Third-party services

The Service may link to or integrate with third-party services, such as app stores or health platforms. We are not responsible for those services, and your use of them is governed by their own terms and privacy policies.

10. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend or discontinue features at any time. Where a change materially reduces what you have paid for, we will give you reasonable notice.

11. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service and its users. Sections that by their nature should survive termination — including disclaimers, limitation of liability and governing law — will continue to apply.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will produce any particular fitness, weight or health result. Individual results vary.

13. Limitation of liability

To the fullest extent permitted by law, BodyTune will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.

14. Indemnity

You agree to indemnify and hold BodyTune harmless from claims, losses and expenses arising out of your misuse of the Service or your breach of these Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which BodyTune is established, without regard to conflict of law rules. Nothing here removes mandatory consumer protections available to you where you live.

16. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, notify you in the app or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
